1. Introduction and Scope

These Terms and Conditions (“Terms”) constitute a legally binding agreement between you, whether acting in your personal capacity or on behalf of an entity (“you”), and CHWIT.MU, operated by Kot Nou Ale Travels Ltd (“Chwit”, “we”, “us”, or “our”).

These Terms govern your access to and use of the website www.chwit.mu (the “Site”), including any related digital platforms, mobile interfaces, applications, or services, as well as any bookings made through our authorised physical outlets in Mauritius (together, the “Services”).

By accessing or using the Site or Services, you confirm that you have read, understood, and agreed to be bound by these Terms.

4. Our Services and Role

CHWIT.MU operates as an online travel booking and facilitation platform.

We provide access to hotel accommodation and flight bookings offered by third-party service providers, including hotels, airlines, and travel aggregators (“Service Providers”).

We do not own, manage, operate, or control any hotels or airlines. Responsibility for the delivery of travel services rests solely with the relevant Service Provider.

5. Payments

Payments for bookings made through the Site may be facilitated using:

Credit Cards or Debit Cards

QR code / scan-to-pay solutions

Credit facilities provided by CIM Finance

Where credit facilities are selected, approval is subject solely to CIM Finance’s assessment criteria. CHWIT.MU does not guarantee credit approval and does not store credit application documents.

6. Modifications to the Service and Prices

Prices for our products are subject to change without notice.

We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.

We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

7. User Accounts

To make bookings, you may be required to create a user account.

You are responsible for:

Maintaining the confidentiality of your login credentials

Ensuring that all information provided is accurate and up to date

We reserve the right to suspend or deactivate accounts that are inactive for an extended period or that contain false or misleading information.

8. User Representations

By using the Site, you represent and warrant that:

You have the legal authority to enter into these Terms

You will use the Site only for lawful purposes

Your use complies with all applicable laws and regulations

12. Bookings, Cancellations, and Refunds

Booking conditions, including cancellation and refund policies, are set by the relevant Service Provider and displayed during the booking process.

Unless expressly stated otherwise:

Bookings may be non-refundable

Amendments or cancellations may not be permitted

No-shows may be charged in full

13. Hotel and Flight Conditions

Each hotel or airline applies its own terms, which may include:

Non-refundability of promotional rates

You are responsible for reviewing and accepting these conditions before confirming a booking.

14. Discount Codes

Discount codes are subject to specific terms, availability, and expiry dates. Unless stated otherwise, codes are:

15. Errors, Inaccuracies and Omissions

Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).

We undertake no obligation to update, amend or clarify information in the Service or on any related website, including without limitation, pricing information, except as required by law. No specified update or refresh date applied in the Service or on any related website, should be taken to indicate that all information in the Service or on any related website has been modified or updated.

Pricing Errors & Technical Malfunctions Policy

i. Accuracy of Information

We strive to ensure that all product descriptions, images, availability, and pricing information displayed on our website are accurate and up to date. However, errors may occasionally occur, including but not limited to typographical errors, system glitches, technical malfunctions, or third-party integration issues.

ii. Pricing Errors

In the event that a product is listed at an incorrect price due to a technical error, bug, human error, or system malfunction:

• We reserve the right to cancel, refuse, or void any order placed at the incorrect price.

• We may correct the price at any time without prior notice.

• If your payment has already been processed for an order affected by a pricing error, we will issue a full refund to the original payment method.

iii. Order Acceptance

Your receipt of an order confirmation email does not constitute final acceptance of your order. A contract between you and Le Warehouse Ltd is formed only when the order has been processed and dispatched.

We reserve the right to refuse or cancel any order for reasons including but not limited to:

• Incorrect pricing

• Product availability issues

• Suspicion of fraud

• System or technical errors

iv. Obvious Errors

If a product is listed at a price that is clearly and unmistakably incorrect (for example, significantly lower than its typical retail value), we are not obligated to honor that price.

16. Termination

We may suspend or terminate your access to the Site or Services at our discretion where there is a breach of these Terms or applicable laws.

17. Disclaimer and Limitation of Liability

The Site and Services are provided on an “as is” and “as available” basis.

To the fullest extent permitted by law:

Our total liability shall be limited to the lower of:

The amount paid by you to CHWIT.MU in the preceding 12 months, or

MUR 10,000

Nothing in these Terms excludes liability that cannot be limited under Mauritian law.

CHWIT.MU acts as a Data Controller under the Mauritius Data Protection Act 2017.

These Terms are governed by and construed in accordance with the laws of the Republic of Mauritius.

The courts of Mauritius shall have exclusive jurisdiction over any disputes arising from these Terms.
